1. Acceptance of Terms

By accessing and using Elf Names Wiki ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Elf Names Wiki provides an AI-powered elf name generator, name encyclopedia, and a character card maker (portrait, backstory and voice pronunciation) for entertainment and creative purposes. The Service is provided "as is" without warranty of any kind.

3. Accounts and Character Cards

• Name generation and card previews are free. Creating a character card (portrait, voice clip, download, sharing) requires a registered account and one card from your balance.
• Free features are subject to daily usage limits, which differ for anonymous visitors and registered accounts. The current limits are published on the pricing page and may be adjusted at any time to control cost or abuse. Purchased cards are not subject to daily limits; one card is consumed per successful generation.
• Cards are purchased individually or in packs through our pricing page. Payments are processed by Creem, our Merchant of Record.
• Purchased cards do not expire and remain in your account until used.
• Cards are non-transferable between accounts.
• Full refunds are available within 7 days of purchase for cards that have not been used.
• Balances from the earlier credit system were converted to cards at a rate of 5 credits per card.

4. AI-Generated Content

• Names, meanings, backstories, portraits, and pronunciations are drafted by artificial intelligence and may not be unique or original. Cards state that the story was drafted with AI.
• You are free to use AI-generated names for personal and commercial projects (e.g., games, novels, tabletop RPGs).
• AI-generated portraits are for personal use. We do not guarantee exclusivity of generated images.
• We are not responsible for any resemblance of generated content to real persons, existing characters, or copyrighted material.
• A card is only consumed on successful generation. If the AI fails to produce a portrait, the card is automatically returned to your balance.
• You may edit the backstory of any card you created. You keep the rights to your edits and grant Elf Names Wiki a licence to display published cards on the site.

5. Intellectual Property

References to fantasy universes (D&D, Lord of the Rings, Elder Scrolls, Warcraft, etc.) are used for educational and reference purposes. All trademarks belong to their respective owners. Elf Names Wiki is an independent fan project and is not affiliated with or endorsed by any of these properties.

6. Acceptable Use Policy & Content Safety

Elf Names Wiki strictly prohibits the generation of the following content through any of its AI features (name generation, portrait generation, voice pronunciation):

• Sexually explicit, nude, semi-nude, or sexually suggestive content
• NSFW content of any kind, including suggestive poses or undressing
• Content depicting minors in any inappropriate context
• Violent, gory, or graphic content
• Hateful, discriminatory, or harassing content targeting any group
• Content that promotes illegal activities
• Deepfakes or content impersonating real individuals

Content moderation: All AI generation is processed through Google Gemini and fal.ai, both of which enforce built-in content safety filters. These filters actively block prohibited content at the model level. We do not offer, promote, or support any "uncensored", "unfiltered", or "NSFW" generation capabilities.

Enforcement: Any attempt to circumvent content safety filters or use the Service to generate prohibited content will result in immediate and permanent account suspension, forfeiture of all remaining cards without refund, and potential reporting to relevant authorities where required by law.

7. Published Character Cards (Community)

• You may publish character cards you created. Published cards, including the name, portrait, story and your display name, are visible to anyone with the link and listed on the community page.
• You keep ownership of the text you write. By publishing, you grant Elf Names Wiki a non-exclusive, worldwide licence to display, cache and share the card on the site and in link previews for as long as it is published. Unpublishing ends the licence except for cached copies that expire on their own.
• Do not publish content that is hateful, harassing, sexual involving minors, that depicts real people, or that presents third-party copyrighted characters as your own.
• Anyone can report a published card. Cards that receive several reports are hidden automatically pending review. We may hide or remove any card at our discretion and may suspend accounts that repeatedly publish prohibited content.
• Card stories start from an AI draft. Cards show whether the author has edited the story.

8. Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose.
• Generate NSFW, sexually explicit, violent, or hateful content.
• Attempt to bypass content safety filters or security measures.
• Use automated tools to access the Service without permission.
• Redistribute or resell AI-generated content in bulk.
• Create multiple accounts to abuse free daily limits.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the Service. AI-generated content may contain errors or inaccuracies.

10. Limitation of Liability

To the maximum extent permitted by law, Elf Names Wiki shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of purchased cards or generated content.

11. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.
